Privacy Policy azuma Apps

Thank you for your interest in our application. The protection of your privacy is very important to us at azuma. azuma sees it as part of its corporate responsibility to protect information and data entrusted to the company. To ensure that you feel secure when using the azuma application, azuma strictly observes the statutory provisions when processing your personal data and would like to inform you in detail about the handling of your data.

2. Is my data secure?

azuma takes contractual, organizational and technical security measures in accordance with the state of the art to ensure that the legal regulations on data protection are complied with and to protect the data processed by azuma against accidental or intentional manipulation, loss, destruction or access by unauthorized persons. The security measures include, in particular, the encrypted transmission of data between your browser and our server.

3. when does azuma collect data about you?

3.1 When using the application

When you use the azuma application, azuma processes the following personal data from you (e-mail address, name, doctor number if applicable). azuma stores technical access data in so-called server log files, such as the name of the requested file, date and time of access, amount of data transferred and the requesting provider. This data is analyzed exclusively to ensure trouble-free operation of the site and to improve the service.

  Which data is collected in each case can be seen from the respective input forms. We use the data you provide to process contracts, provide services and process your inquiries.

3.2 How to contact us

You have various options for contacting azuma. These include the contact form on the website and contacting us by email. In this context, azuma processes data exclusively for the purpose of communicating with you. The legal basis is Art. 6 para. 1 lit. b GDPR. The data collected by us when using the contact form will be automatically deleted after your request has been fully processed, unless we still need your request to fulfill contractual or legal obligations.

4. What is the data used for at azuma?

4.1. to fulfill the contract or to carry out pre-contractual measures (Art. 6 para. 1 letter b GDPR)

azuma uses your data with the aim of answering your inquiries in full. In doing so, we handle your data responsibly. azuma uses your data in detail for 

  • providing the application
  • answering your inquiries
  • processing your service requests.

4.2 In the context of the balancing of interests (Art. 6 para. 1 letter f GDPR)

azuma may also use your data on the basis of a balancing of interests to protect the legitimate, usually economic interests of azuma or third parties, whereby pseudonymized or anonymized data will be processed where possible. This is done for the following purposes:

  • Monitoring and improving the efficiency and legal certainty of business processes
  • Control, optimization and further development of services and products
  • Carrying out advertising (e.g. postal advertising or direct marketing), market and opinion research on the basis of presumed consent from B2B customers
  • Assertion of legal claims and defense in legal disputes
  • Detection, prevention and investigation of criminal offenses
  • Ensuring the security and operability of our IT systems

If you have given consent to azuma to process your data, the respective consent is the legal basis for the processing covered by the consent. This applies in particular to any consent you may have given for advertising by telephone or email.

You can revoke your consent at any time with effect for the future. Unsubscribing from the newsletter is possible at any time and can be done either by sending a message to the above-mentioned contact details or via a link provided for this purpose in the newsletter.

azuma is subject to various legal obligations, e.g. statutory retention obligations in relation to business documents and export regulations.

5. disclosure of your data

If external service providers are used to operate this application or to provide services (hosting providers, etc.), the companies concerned will only have access to your data to the extent necessary to fulfill their respective tasks and functions.

  If these service providers process your data outside the European Union, this may result in your data being transferred to a country that does not offer the same data protection standards as the European Union. In this case, we ensure that the respective recipients of your data contractually or otherwise guarantee a level of data protection equivalent to that of the European Union. 

We conclude order processing contracts or joint responsibility contracts with our service providers, which may contain the current standard contractual clauses of the European Commission (as of June 2021). If the processing of your personal data involves a transfer to a third country (e.g. because we use a service provider that has its server structures in a third country), we will explain this to you at the appropriate point in this privacy policy.

6 Why does this application use cookies?

In order to make your visit to our application attractive and to enable the use of certain functions, we use so-called cookies on various pages. These are small text files that are stored on your end device. Some of the cookies we use are deleted again at the end of the browser session, i.e. after you close your browser (so-called session cookies). Other cookies remain on your end device and enable us to recognize your browser on your next visit (persistent cookies). You can set your browser so that you are informed about the setting of cookies and decide individually whether to accept them or to exclude the acceptance of cookies for certain cases or in general. If you do not accept cookies, the functionality of our application may be limited.

  Most web browsers (see help function in the menu bar of your browser) can be set by you so that they do not accept new cookies, that you receive a message that a new cookie has been placed or that all cookies received are switched off. For smartphones, tablets and other mobile and stationary devices, you can find the necessary settings in the respective operating instructions.  However, we recommend that you leave the cookie functions switched on completely, as only with cookies is it possible to further improve our application for your needs. Our cookies do not store any sensitive data such as passwords, credit card details or similar. They do not cause any damage to your end device and do not contain any viruses.

  Cookies that are required to carry out the electronic communication process or to provide certain functions you have requested (e.g. language settings) are stored on the basis of Art. 6 para. 1 lit. f) GDPR. The website operator has a legitimate interest in the storage of cookies for the technically error-free and optimized provision of its services. Insofar as other cookies (e.g. cookies to analyze your surfing behavior) are stored, these are treated separately in this privacy policy.

  The opt-out cookie is only valid in this browser and only for our website and is stored on your device. If you delete the cookies in this browser, you must set the opt-out cookie again.

7. When will your data be deleted?

azuma adheres to the principles of data minimization and data avoidance. This means that your data will only be stored for as long as is necessary to achieve the purposes of data processing or as stipulated by the various storage periods provided for by law. If the respective purpose no longer applies or after the corresponding periods have expired, your data will be routinely blocked or deleted in accordance with the statutory provisions. Further information can be found in the respective user agreement of the application.

8. What data protection rights do you have?

You have the right of access (Art. 15 GDPR), the right to rectification (Art. 16 GDPR), the right to erasure (Art. 17 GDPR), the right to restriction of processing (Art. 18 GDPR) and the right to data portability (Art. 20 GDPR). You also have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR).

If you have given your consent to azuma, you can revoke it at any time with effect for the future by sending an e-mail to privacy@azuma.health.

  If azuma processes your data on the basis of a balancing of interests, you can object to the processing. If you object, your data will no longer be processed unless the responsible company can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defense of legal claims.
